Commissioned Artwork Fact Sheet 2024

This document is to inform you, the potential Collector/Buyer, of L Godfrey Fine Art, LLC’s process and guidelines for commissioning a piece of artwork from L Godfrey Fine Art, LLC (the “Company”) created by artist Lindsay Godfrey.

  1. General Information

    1. Lindsay’s calendar only allows for a few commission pieces a year.  If you are interested in working with the Company to commission a piece of art created by Lindsay, please send an email to lgodfreyfineart@gmail.com. The Company will respond with a link to a commission submission request form. Please fill out the form and submit your request. Once your submission is reviewed, the Company will inform you if your request is accepted.  

    2. The Company retains the right to refuse any commission request.

    3. If the Company is interested in accepting your commission request, it will email you a commission estimate, which will have more details regarding the possible timeframe and pricing of the commission piece. 

    4. After you review the estimate and decide to move forward the Company will send you a commission contract to sign. The contract will require that you pay the Company a nonrefundable deposit in the amount of 30% of the total price. Lindsay will start the artwork after (a) the Company receives the commission contract signed by you and Lindsay, as the Company’s manager, and (b) the Company receives the nonrefundable deposit.

    5. The Company is not accepting any international commission requests at this time.

  2. Process

    1. In Lindsay’s art process, she will usually take a combination of images and arrange them into a cohesive work of art. For a commission piece, Lindsay will request 3-5 images to help create the work you are looking for. She also requires 1 or 2 suggestions of her currently listed works to draw from. This will help Lindsay get ideas on subject matter (water, mountains, sunrise, etc…) as well as color schemes (warm or cool colors).

    2. Then, Lindsay will create 1 or 2 preliminary sketches to present. At that time there will be an opportunity for you to make suggestions for changes. After this initial conversation, there will be no additional changes or requests accepted.

    3. The Company is not obligated to send you updates or images of the process, but the Company will inform you when the artwork is complete.

    4. After the artwork is completed you and the Company will discuss and decide how the artwork will be delivered to you.

  3. Pricing

    1. Commission pieces are priced by the square inch. The Company currently charges $2.50 per square inch as of 2024. The Company reserves the right to change its commission pricing structure at any time.

    2. As stated above, the Company requires 30% of the total quoted price as a nonrefundable deposit before starting an agreed-upon commission piece. The remaining 70% will be paid before shipping/delivery of the final piece. There may also be some additional shipping costs (to be calculated at the time of final payment and paid by the Collector/Buyer).

  4. Payment

    1. The Company’s preferred method of payment is PayPal, Venmo, or Cashier’s Check, and it does not accept personal checks.

  5. Copyright

    1. The Collector/Buyer’s ownership of the physical artwork does not transfer ownership of the artwork’s copyright. The Company reserves the common-law copyright to all works commissioned by the Collector/Buyer (including all preliminary sketches). The Company also reserves all reproduction rights and the right to claim statutory copyright. No work may be reproduced by the Collector/Buyer without prior written approval of Lindsay, as manager of the Company, who is also the Artist. The Company reserves the right to use the reproductions of the artwork to promote Lindsay’s work. This includes the right to display reproductions of the artwork on the Company’s website.

  6. Right of Refusal

    1. It is the Company’s intent to create a work to be purchased by the Collector/Buyer. However, if, after the artwork is completed, the Collector/Buyer does not wish to purchase any or all of the work, the Collector/Buyer may refuse the completed artwork. In that case, the Company will retain the refused artwork and the nonrefundable deposit of 30% of the total commission price, free of any claims or interests of the Collector/Buyer.
